Melanie Trevethick’s High Court trial case, against the Ministry of Health, challenging the difference between ACC and the MoH funding is headed for the Appeal Court. This follows the High Court’s decision on
Melanie’s challenge which has just been released. struck out on the comparator issue i.e. - can I as a person with an illness, compare myself to someone who's had an accident - but agreeing with Crown Law on the cause application, (can the word 'cause' be read into the Human Rights Act.) It's another 'one-all' result” said Melanie “although we needed both decisions to go our way to achieve a full and substantive Human Rights hearing. While some may view the High Court decision as a knockback Melanie is positive over the outcome. “My legal challenge is the vehicle for which media interest and exposure can focus but in itself is only part of the equation, “explained Melanie. “What we need to do now is to encourage our respective members to register their support for equity-for-illness by writing to their MPs and to write letters to the Editor of their local newspapers. This will ultimately keep our cause alive in the public's mind.” |
| “We must not miss this opportunity in an election year. Don’t give up hope. We can make a difference, urged Melanie. | |
